Motorcyclist injured by uninsured driver, Perak highway
Motor Vehicle Claim — resolved March 2025
Challenge
Client suffered fractures to his left arm and collar bone when struck by a vehicle that was subsequently found to be uninsured. Insurers initially declined to engage given the at-fault driver's status.
Approach
Claim submitted to the Motor Insurers' Bureau of West Malaysia under the uninsured driver provisions. Medical records obtained and schedule of loss prepared drawing on the Compendium for equivalent fracture injuries.
Outcome
MIB accepted liability and a settlement was reached within 18 months of the initial filing, covering general damages, medical expenses, and loss of income during the recovery period.
Post-surgical complication following elective procedure
Medical Negligence Preparation — ongoing from January 2025
Challenge
Client developed a serious infection following a routine orthopaedic procedure. Family believed the post-operative care fell below standard but had no independent medical view on whether the outcome was avoidable.
Approach
Full clinical records obtained from the treating hospital. An independent orthopaedic specialist was engaged to assess whether the post-operative monitoring and care met the Bolam standard. The specialist's preliminary view supported a potential breach.
Where it stands
Writ proceedings have been filed. The matter is at the early stages of civil litigation. The family has been advised of the expected multi-year timeline and has found the regular updates from our team helpful in managing uncertainty.
Scaffolding collapse at construction site, Ipoh
Workplace Injury — SOCSO appeal resolved February 2025
Challenge
Worker suffered spinal injuries when scaffolding collapsed on site. Initial SOCSO invalidity assessment placed him at a lower disability percentage than his treating doctor believed was accurate.
Approach
Nithya attended the review medical board hearing with the client and submitted a formal written challenge to the initial assessment, supported by the treating specialist's report and an independent orthopaedic review.
Outcome
The SOCSO Appellate Board revised the invalidity percentage upward, resulting in materially higher monthly benefit payments. A separate third-party negligence action was subsequently advised and is being prepared.
