How long does a personal injury claim typically take in Malaysia?
It depends on the nature of the matter. Motor vehicle claims resolved by negotiation with insurers can sometimes conclude within 12 to 18 months. Medical negligence claims, which involve independent expert review and often Writ proceedings, typically span several years. Workplace injury matters vary based on whether SOCSO appeals or court action is involved. We will give you a realistic picture at the outset.
What documents should I bring to the first meeting?
Bring whatever you have — even a partial set of documents is a useful starting point. Useful items include police reports (NPI), medical receipts and discharge summaries, photographs of injuries or the accident scene, correspondence with an insurer or employer, and any SOCSO claim reference numbers. We will identify any gaps after the first meeting.
Is there a time limit on making a personal injury claim?
Yes. Under the Limitation Act 1953, the general limitation period for personal injury claims is three years from the date of the injury or from the date of knowledge. Certain exceptions apply — for instance, claims involving minors or where the injury was not immediately apparent. If you are unsure how time limits apply to your situation, it is worth discussing this early.
